The HSUS's second suit against the National Marine Fisheries Service for failing to limit ship speeds in critically endangered North Atlantic right whale habitat in order to avoid fatal collisions. Despite promising the court during the first round of litigation that the agency would issue final rules by June 2007, the agency continues to refuse to act, even as the right whale population dwindles to less than 400 individuals.
