For years the Dogwood Gun Club has hosted bi-annual pigeon shoots at which approximately 40,000 pigeons are killed. When authorities threatened prosecution under the cruelty statute, Malloy challenged the constitutionality of the law and was able to enjoin prosecutors from enforcing the law. Since that time, North Carolina law has changed, making pigeon shooting illegal. The HSUS has filed a motion to intervene in the North Carolina Court of Appeals to disolve the injunction and allow local authorities to shut down the pigeon shoot.
