Delaware Canned Hunt Statutes and Regulations

Statute

Under Delaware statutes "no person shall make use of any pitfall, deadfall, scaffold, cage, snare, trap, net, pen, baited hook, lure, urine or baited field or any other similar device or any drug, poison, chemicals or explosives for the purpose of injuring, capturing or killing birds or animals protected by the laws of this State, except muskrats, raccoon, opossum, minks, snapping turtles and otters, and except as otherwise expressly provided." 7 D.C.A. §704.

Licenses are required for any person who desired to engage in the business or industry of breeding game animals or game birds. Id. at §561(a). A license, at the cost of $25, is also required for any persons, clubs, or associations who desire, pursuant to regulations issued by the Department, to engage in experimental propagating, holding, raising, releasing and shooting of rabbits and game birds. Id. at §582.

Regulation

Delaware regulations pertaining to the establishment and operation of shooting preserves are quite limited. The Division of Fish and Wildlife "may issue permits to allow the taking of captive-reared mallards during the established waterfowl season under applicable federal regulations." WR-3 §4. Permits are only issued to persons who: "control at least 100 acres of land on which there is suitable waterfowl habitat; agree to follow a management plan and federal regulations; and maintain a log of guests and birds harvested." Id. In addition, "it shall be unlawful for any person to hunt liberated game on licensed game preserves from April 1 through October 14." WR-6.

According to an official of the Delaware Division of Fish and Wildlife (302-739-9912), Delaware does not have any hunting facilities or shooting preserves on which mammals are hunted from within fenced enclosures. While the state does issue shooting preserve licenses which permit the release and shooting of rabbits and game birds, the official indicated that the animals are not at any time held captive or have their escape restricted by any sort of enclosures.
